باب 60

(60) باب مَقَامِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا فِي بَيْتِهَا حَتَّى تَحِلَّ

(60) Chapter: The Woman Whose Husband Has Died Staying In Her House Until It Becomes Permissible For Her To Remarr (AR)

أَخْبَرَنَا مُحَمَّدُ بْنُ الْعَلاَءِ، قَالَ حَدَّثَنَا ابْنُ إِدْرِيسَ، عَنْ شُعْبَةَ، وَابْنِ، جُرَيْجٍ وَيَحْيَى بْنِ سَعِيدٍ وَمُحَمَّدِ بْنِ إِسْحَاقَ عَنْ سَعْدِ بْنِ إِسْحَاقَ، عَنْ زَيْنَبَ بِنْتِ كَعْبٍ، عَنِ الْفَارِعَةِ بِنْتِ مَالِكٍ، أَنَّ زَوْجَهَا، خَرَجَ فِي طَلَبِ أَعْلاَجٍ فَقَتَلُوهُ - قَالَ شُعْبَةُ وَابْنُ جُرَيْجٍ وَكَانَتْ فِي دَارٍ قَاصِيَةٍ فَجَاءَتْ وَمَعَهَا أَخُوهَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَذَكَرُوا لَهُ فَرَخَّصَ لَهَا حَتَّى إِذَا رَجَعَتْ دَعَاهَا فَقَالَ " اجْلِسِي فِي بَيْتِكِ حَتَّى يَبْلُغَ الْكِتَابُ أَجَلَهُ " .

It was narrated from Al-Fari'ah bint Malik that her husband went out to pursue some slaves and they killed him. Shu'bah and Ibn Juraij said:
"She was in a remote house. She came with her brothers to the Messenger of Allah and told him (about the situation) and he granted her a concession. When she was leaving he called her back and said: 'Stay in your house until the term prescribed is fulfilled.'" (AR)
