(15) باب مَنْ بَاعَ نَخْلاً عَلَيْهَا ثَمَرٌ

(15) Chapter: One who sells date palms on which there are dates (AR)

حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ " مَنْ بَاعَ نَخْلاً قَدْ أُبِّرَتْ فَثَمَرَتُهَا لِلْبَائِعِ إِلاَّ أَنْ يَشْتَرِطَ الْمُبْتَاعُ ".

Ibn Umar (Allah be pleased with them) reported Allah's Messenger (ﷺ) as saying:
If anyone buys palm-trees after they have been fecundated the fruit belongs to the seller unless the buyer makes a proviso. (AR)
