(15) باب مَا جَاءَ لاَ نِكَاحَ إِلاَّ بِبَيِّنَةٍ

(15) Chapter: What Has Been Related About: There Is No Marriage Except With Proof (Bayyinah) (FR)

حَدَّثَنَا يُوسُفُ بْنُ حَمَّادٍ الْمَعْنِيُّ الْبَصْرِيُّ، حَدَّثَنَا عَبْدُ الأَعْلَى، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ جَابِرِ بْنِ زَيْدٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ " الْبَغَايَا اللاَّتِي يُنْكِحْنَ أَنْفُسَهُنَّ بِغَيْرِ بَيِّنَةٍ " . قَالَ يُوسُفُ بْنُ حَمَّادٍ رَفَعَ عَبْدُ الأَعْلَى هَذَا الْحَدِيثَ فِي التَّفْسِيرِ وَأَوْقَفَهُ فِي كِتَابِ الطَّلاَقِ وَلَمْ يَرْفَعْهُ .

Ibn Abbas narrated that :
the Prophet said: "The adulteresses are the ones who marry themselves without Bayyinah (proof)." (FR)
