باب 29

(29) بَابُ إِذَا اخْتَلَفُوا فِي الطَّرِيقِ الْمِيتَاءِ- وَهْيَ الرَّحْبَةُ تَكُونُ بَيْنَ الطَّرِيقِ- ثُمَّ يُرِيدُ أَهْلُهَا الْبُنْيَانَ، فَتُرِكَ مِنْهَا الطَّرِيقُ سَبْعَةَ أَذْرُعٍ

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا جَرِيرُ بْنُ حَازِمٍ، عَنِ الزُّبَيْرِ بْنِ خِرِّيتٍ، عَنْ عِكْرِمَةَ، سَمِعْتُ أَبَا هُرَيْرَةَ ـ رضى الله عنه ـ قَالَ قَضَى النَّبِيُّ صلى الله عليه وسلم إِذَا تَشَاجَرُوا فِي الطَّرِيقِ بِسَبْعَةِ أَذْرُعٍ.

Narrated Abu Huraira:
The Prophet (ﷺ) judged that seven cubits should be left as a public way when there was a dispute about the land. (PT)
